Operations near Military-Controlled Aerodromes (CASA EX23/23)

Effective from April 30, 2023, ReOC (Remote Operator Certificate) holders intending to fly below 400ft (120m) above ground level (AGL) in a no-fly zone of a military-controlled aerodrome do not need to apply to CASA.

Requirements:

Add a copy of Instrument 23/23 to their operator's manual (updated manuals do not need to be sent to CASA).

Obtain approval from the military control tower before the operation by contacting the tower or military unit overseeing the area where the flight will take place.

Flying above 400ft still requires submitting an application to CASA, who then notify the Department of Defence of the approval.

Regardless of altitude, issuing a Notice to Airmen (NOTAM) is mandatory when flying in a no-fly zone of a military-controlled aerodrome. The NOTAM can be issued by the military control tower. This is a condition of CASR 101.030 and Instrument 23/23.

BVLOS Operations (CASA EX27/23):

CASA has updated the minimum requirements for remote pilots conducting BVLOS operations.

Changes:

EVLOS (Extended Visual Line of Sight) Class 2 remote pilots are no longer required to pass the instrument rating exam (IREX) in specific situations.

Still Required:

Operating under a ReOC.

Obtaining an EVLOS approval.

Having procedures approved by CASA.

Companies operating under a ReOC with a current EVLOS Class 2 approval can utilize these changes immediately, and CASA does not require updated practices and procedures.

The need to hold an IREX for EVLOS Class 2 operations is now optional.

CASA EX27/23 replaces the previous regulation CASA EX46/21.

These updates indicate that CASA is streamlining the regulatory process for ReOC holders who wish to fly near military-controlled aerodromes and making it more convenient for remote pilots to conduct BVLOS operations under certain conditions. The changes aim to reduce unnecessary administrative burdens while still maintaining safety standards.
